PREAMBLE
The Seller operates an e-commerce business and offers an online sales service for Products on the website www.jagvi.eu These general terms and conditions (hereinafter referred to as “Conditions”) are exclusively reserved for consumer and non-professional Buyers.
ARTICLE 1 – DEFINITIONS

ARTICLE 2 – PURPOSE
The purpose of these Conditions is to define the rights and obligations of the Seller and the Buyer in connection with the sale of Products through the Site.
ARTICLE 3 – SCOPE OF APPLICATION
These Terms apply to all sales of Products by the Seller to the Buyer, made through the Site. www.jagvi.eu The seller reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the terms and conditions of sale in effect on the date of the order will apply to each order. An order will only be processed by the seller after the buyer has accepted these terms and conditions.
ARTICLE 4 – ORDER
The Buyer places their Order via the Website. All contractual information is presented in French and English and will be confirmed no later than at the time of delivery.
ARTICLE 4.1 – ORDER VALIDATION
The Buyer declares having read the Terms and Conditions prior to placing their Order, which are available on the website, and acknowledges that validating their Order implies acceptance of these terms. The Buyer further acknowledges that the Terms and Conditions are made available in a manner that allows for their storage and reproduction, in accordance with Article 1369-4 of the French Civil Code. To place an Order, the Buyer must provide the Seller with their personal data and complete an online form accessible from the Website. Until the final step, the Buyer will have the opportunity to return to previous pages and correct or modify their Order and the information previously provided. A confirmation email, acknowledging receipt of the Order and summarizing all this information, will then be sent to the Buyer as soon as possible. The Buyer must therefore provide a valid email address when filling in the fields relating to their identity.
ARTICLE 4.2 – VALIDITY OF THE OFFER – PRODUCT UNAVAILABILITY
The offers presented by the Seller on the Website are valid as long as they are visible on the site, within the limits of available stock. Photographs and descriptions of the products are provided for illustrative purposes only and may be subject to slight modifications without incurring any liability on our part or affecting the validity of the sale. Upon receipt of your order, we will check the availability of the product(s) ordered. Should a product ordered by the Buyer be unavailable, the Seller undertakes to inform the Buyer by email as soon as we become aware of this unavailability. In the event of unavailability, we undertake to offer you either an exchange or a refund within 30 days of order confirmation. If one of the products in your order is out of stock: We will ship the remainder of your order.
ARTICLE 5 – PRICE – PAYMENT
The prices of the Products displayed on the Site pages are inclusive of all taxes but exclusive of any contribution to logistics and shipping costs. The Seller reserves the right to modify the prices of the Products presented on the Site. However, the Products will be invoiced to the Buyer based on the rates in effect at the time the Order is validated.
ARTICLE 5.1 – PAYMENT METHOD
Payment for the order will be made: – By credit card: payment is made via a secure banking server at the time of the order, or by check. This means that none of your banking information passes through the website www.jagvi.eu Card payments are therefore perfectly secure; the personal information transmitted from the site www.jagvi.eu All data processed at the center is protected and encrypted using SSL (Secure Socket Layers); your order will be registered and validated as soon as the bank accepts the payment. Payment orders made by credit card cannot be canceled. Therefore, the Buyer’s payment for the Order is irrevocable, without prejudice to the Buyer’s right to withdraw from or subsequently cancel the Order.
ARTICLE 5.2 – TRANSFER OF OWNERSHIP
Ownership of the Product will only transfer to the Buyer upon full payment of the price by the Seller. However, from the moment the customer receives the order, the risks associated with the delivered goods are transferred to the customer.
ARTICLE 5.3 – DEFAULT OF PAYMENT
JAGVI. Rive Gauche reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is being administered.
ARTICLE 6 – DELIVERY
Columbus SAS has a contractual agreement with La Poste (the French postal service). All packages are shipped via their services. Shipping costs are calculated based on weight and destination, are automatically displayed when you confirm your order, and are included in the total price. The product will be delivered to the address provided by the buyer on the order form. All delivery times are calculated in business days. The seller commits to processing the order within thirty days from the day after order confirmation. If the shipping deadline is exceeded, the order may be canceled as long as it has not yet been shipped from our warehouses. To do so, simply contact our Customer Service. If you receive the package, refuse delivery and request a refund from our Customer Service. Once we have confirmation of the return of your package, we will issue a refund within 15 days. The indicated delivery times are average times and correspond to the processing, preparation, and shipping time of your order (departure from our warehouses). They begin from the moment the order is validated. To this time, you must add the carrier’s delivery time. Products always travel at the recipient’s risk, who, in the event of delay, damage, or missing items, must file a claim against the carrier or make the necessary reservations with the carrier to allow for this claim. If the Product is delivered after the Order has been canceled, the refund will be issued upon receipt of the Product by the Seller in its original condition. The return of the Product and the Buyer’s refund will take place under the conditions set forth below in Article 7, “Cancellation – Withdrawal – Refund.”
ARTICLE 7 – CANCELLATION – WITHDRAWAL – REFUND
ARTICLE 7.1 – RIGHT OF RETURNS
Procedure and general conditions: To ensure proper identification and optimal processing of returns, any product requiring return must be the subject of a return request submitted to our customer service department, otherwise it will be refused. The time allowed for contacting our customer service department depends on the reason for the return. The return request must be made to our customer service department: contact@jagvi.eu You will receive an email confirming receipt of your return request. Upon delivery of the product, you have 15 days to return it to JAGVI, 11 rue des Saints Pères, 75006 Paris, France. After this period, your return will be refused. We recommend using a tracked shipping method. Otherwise, if the package you send back to us does not reach us, you will not be able to initiate an investigation with the postal service to locate it. Please note that we are not responsible for any packages not shipped by us. Only the sender of the package can initiate an investigation with the postal service. To process your request correctly, please provide your order number and full contact details. Note: Upon receipt, our team will check the returned product for conformity and verify the reason for the return. If the returned product is not in its original condition, or if it is not properly packaged and returned folded, it will be refused by our services and returned to you at your expense. If your return is made under an incorrect reason, your product may be refused and returned to you at your expense. The reason for return may be reclassified. In this case, you will be notified by email, and the processing of your return will then depend on the new reason.
ARTICLE 7.2 – RIGHT OF RETURN FOR WITHDRAWAL
Upon receipt of the Product, the Buyer has a 14-day withdrawal period, allowing them to return the delivered product to JAGVI, 11 rue des Saints Pères, 75006 Paris, France, without having to provide any specific reason. If the Buyer exercises this right of withdrawal within 14 calendar days of receiving the Product, the Seller undertakes to reimburse the Buyer without delay and at the latest within thirty days of the date on which this right was exercised. This reimbursement is subject to the return conditions mentioned in Article 7.1. IMPORTANT: No return will be accepted if the returned product is unsuitable for resale. Therefore: – The product must be returned in perfect condition, in its original packaging, undamaged, unmarked, folded as it was originally shipped, and uncreased. A product returned crumpled will be systematically refused. The product must be returned with all its accessories and packaging. Otherwise, the product will be returned to you at your expense. Return postage costs will be borne by the Buyer. To exercise this right, the Buyer must first contact customer service: contact@jagvi.eu An email acknowledging receipt of this return request will be sent.
Products purchased from the collection during promotional and sale periods will only be accepted for return and exchange; refunds are not issued on discounted items. Only full-price items are eligible for return and refund at the Buyer’s request.
ARTICLE 7.3 – RETURNS FOR REFERENCE ERRORS
Return Policy: You have 15 days to notify us if the product received is not the product ordered: incorrect item number, size, color, or specifications; a completely different product; a defective product, etc. Our customer service department will then issue you a return authorization number. The product must be returned in good condition and in its original packaging to JAGVI, 11 rue des Saints Pères, 75006 Paris, France, even if the packaging has been opened, with all its contents. To process your request correctly, please provide your order number and complete contact information. After receiving and accepting your package, we will resend the product or issue a refund within 15 days. Refunds are based on La Poste rates and will not exceed €8 including VAT. A flat fee of €20 may be applied if return procedures are not followed.
ARTICLE 8 – WARRANTY
The Buyer benefits from the warranty against hidden defects as provided for in Article 1641 of the French Civil Code. Non-conforming products will be replaced or refunded.
ARTICLE 9 – LIABILITY
The Seller’s liability is limited to direct and foreseeable damages. The Seller is not liable for misuse, third-party issues, or force majeure.
ARTICLE 10 – INTELLECTUAL PROPERTY
All site elements are protected by intellectual property law and belong to the Seller. Unauthorized use is prohibited.
ARTICLE 11 – PERSONAL DATA
Personal data is collected, processed securely, and used only for order processing and service improvement. Buyers may request access, correction, or deletion by contacting contact@jagvi.eu.
ARTICLE 12 – CONVENTION ON EVIDENCE
It is expressly agreed that the Parties may communicate with each other electronically for the purposes of these Terms and Conditions, provided that technical security measures are implemented to guarantee the confidentiality of the data exchanged. Both Parties agree that emails exchanged between them constitute valid proof of the content of their communications and, where applicable, of their commitments, particularly with regard to the transmission and acceptance of Orders.
ARTICLE 13 – PARTIAL DISABILITY
If one or more of the provisions of the Conditions were deemed unlawful or void, this invalidity would not have the effect of rendering the other provisions of these Conditions void, unless these provisions were inextricably linked to the invalidated provision.
ARTICLE 14 – APPLICABLE LAW
These Terms and Conditions are governed by French law.
ARTICLE 15 – ATTRIBUTION OF JURISDICTION
The Parties agree that in the event of any dispute arising concerning the performance or interpretation of these Terms and Conditions, they will endeavor to reach an amicable settlement. If this attempt at amicable resolution fails, the dispute will be submitted exclusively to the Commercial Court of Annecy.
